Terms & Conditions of Booking Services with Patrao Onn Retreats Pvt. Ltd. 

1. How These Terms Apply & Definitions

These Terms & Conditions ("Terms") govern every booking made for a tour, walk, trek, experience, homestay, or related service (each, an "Experience") offered under the Tikigai brand by Patrao Onn Retreats Private Limited ("Tikigai", "Company", "we", "us", "our").

No physical or digital signature is required for these Terms to apply. By making a booking, sending payment, confirming a date, or otherwise engaging our services through any medium,  including WhatsApp, Instagram, phone call, email, our website, in person, or through a third-party platform or partner acting on our behalf,  you agree to be bound by these Terms in full, on behalf of yourself and every person included in that booking.

If any part of these Terms is not acceptable to you, please do not proceed with a booking. Continuing with a booking after being directed to these Terms is treated as acceptance, whether or not you have read them in full.

Participant, Traveller, Guest, Customer or You refers to every individual who books, attends or participates in an experience.

Guide includes Company employees, local experts, volunteers, community hosts or any individual authorised by the Company to conduct or facilitate an experience.
 

2. Who We Are

Tikigai is a slow-travel and heritage experience brand operating in South Goa, run by Patrao Onn Retreats Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at Laxmi Plaza, Behind Grace Church, Margao, Salcette, South Goa- 403601, Goa. References to "Tikigai" in any marketing, on WhatsApp, or on social media refer to this Company.
 

3. Booking & Payment

A booking is only confirmed once we have acknowledged your payment (in full, or as a deposit where we expressly allow this) in writing, a message on WhatsApp or email is sufficient acknowledgment.

We currently accept payments via [UPI / bank transfer / payment link / cash]. We do not store your full card or bank details.

If you are booking on behalf of a group, family, friends, or a corporate/school group,  you are confirming that you have the authority to accept these Terms for everyone in that group, and that you have made them aware these Terms apply to their participation.
 

4. Pricing

Prices are set based on costs at the time we quote them and we make every effort to hold that price. In rare cases, a sharp rise in fuel or transport costs, a new government levy, or something else genuinely outside our control,  we may need to revise the price even on a confirmed booking, and we will always tell you before your Experience begins if this happens.

Unless we've said otherwise for a specific Experience, prices don't include personal expenses (shopping, drinks outside a specified meal, medical costs) or extra costs caused by your own delay, illness, or travel changes.
 

5. Changes, Cancellations & Refunds

5.1 If you need to cancel or reschedule

Let us know in writing (WhatsApp, SMS, or email) as soon as you know you need to change plans. Depending on notice given before your Experience's scheduled start time:

  • 72 hours or more notice: full refund, minus any non-recoverable costs we've already committed on your behalf (e.g., a prepaid homestay booking or permit fee).

  • 24–72 hours notice: 50% of the amount paid is refunded.

  • Less than 24 hours notice, or a no-show: no refund.

 

5.2 If we need to change or cancel

We may reschedule, modify, or cancel an Experience where we reasonably believe it's necessary for your safety,  heavy rain, flooding risk, a Supplier becoming unavailable, or similar. If the reason is within our control, we'll offer a full refund or a new date. If it's due to weather, government restriction, or another circumstance outside our control (see Clause 11), we'll refund what hasn't already been paid to, or can be recovered from, our local partners, but can't offer further compensation for costs you've booked independently, like flights or hotels.
 

6. Your Responsibilities as a Traveller

Before and during your Experience, please:

  • Choose an Experience that suits your fitness, mobility, and comfort with the outdoors, our team is always happy to advise if you're unsure;

  • Carry valid identification whenever required.

  • Tell us in writing, before the Experience, about any medical condition, injury, pregnancy, or other factor that could affect your ability to take part safely;

  • Wear suitable footwear and clothing, and bring anything we've specifically advised (water, sun protection, a change of clothes);

  • Follow the directions of your guide or host, especially near water, on uneven ground, or around wildlife and heritage sites;

  • Treat guides, hosts, fellow travellers, and the communities we visit with respect; 

  • Avoid alcohol or substances that could impair your judgment or safety during an Experience.

We may, at our discretion, decline to let someone join, or ask them to leave partway through, an Experience if their health, conduct, or condition puts themselves or others at risk. No refund applies in that situation.
 

7. Outdoor & Adventure Experiences - What You Should Know

Some of our Experiences, hinterland treks, forest safaris, and waterfall visits among them,  take place on natural terrain: forest trails, riverbanks, and rocky ground that can be uneven, wet, or remote. We plan every route carefully and our guides know the terrain well, but the outdoors carries some risk that no amount of planning removes entirely, including:

  • Slipping, tripping, or falling on natural ground, wet rocks, or riverbeds;

  • Contact with plants, insects, or wildlife;

  • Currents, submerged rocks, or changes in depth when wading, swimming, or standing near flowing water;

  • Sudden weather changes, rain, heat, humidity, low visibility;

  • Limited mobile signal or slower access to medical help in remote spots.

 

Some of our Experiences, The Village Overnight Stay (The OG Village Stay) among them,  the original stay is at a rural village, at someone’s actual home. We plan to provide you with basic amenities as is available in the village but being at a remote location means that you might face certain situations such as Power Cuts, heavy rainfall, low temperatures, mosquitoes, no immediate medical care among others. 

If you choose to join one of these Experiences, you're telling us that you understand these are real, if uncommon, risks, not hypothetical ones,  and that you're fit enough to take part and will follow your guide's safety directions throughout.
 

8. Waiver of Liability & Indemnity

In exchange for being allowed to take part in an Experience, and to the fullest extent the law allows, you agree that:

  • You take on, personally, the risk of injury, illness, loss, damage, or death that can arise from ordinary outdoor and travel activity as described in Clause 7,  this includes, specifically, slipping, falling, or drowning-related incidents during a trek, walk, or waterfall visit, except where that harm is directly caused by Tikigai's own gross negligence or wilful misconduct;

  • You will not hold Patrao Onn Retreats Private Limited, its directors, staff, guides, or partners responsible for such injury, illness, loss, damage, or death, and you release us from claims of this nature, other than claims arising from our proven gross negligence or wilful misconduct;

  • You will cover us for any claim brought by you, your family, or anyone on your behalf, connected to such an incident, other than a claim arising from our proven gross negligence or wilful misconduct;

  • This clause applies to the maximum extent permitted by Indian law, and if a court finds any part of it unenforceable, the rest continues to apply.
     

9. Limits on Our Liability

Other than for death or personal injury caused by our proven gross negligence or wilful misconduct, which we do not exclude or limit, our total responsibility to you for anything arising from an Experience is capped at the amount you paid us for that Experience.

We are not responsible for indirect losses, lost holiday enjoyment, missed time, or costs you've arranged independently of us, such as flights or hotel stays not booked through us.
 

10. Our Local Partners

Many of our Experiences are delivered together with local or third party partners,  homestay families, drivers, and independent guides, who we choose carefully and adhere to protocols/SOP’s, but who are not our employees. We stand behind the experience we curate, but where a partner is acting independently and outside our direct supervision, our responsibility for their specific actions is limited as set out in Clause 9, except where the law requires otherwise.

Please treat our partners, their homes, land, and belongings the way you'd want a guest treated in your own home, it's the foundation of how we're able to keep offering these Experiences at all.
 

11. Events Outside Our Control

We won't be held responsible for delays, changes, or cancellations caused by circumstances genuinely beyond our control, extreme weather, flooding, fire, public health emergencies, government orders, strikes, civil unrest, or similar. Where this happens, Clause 5.2 governs what refund, if any, applies.
 

12. Photos, Videos & Marketing

We often take photos or short videos during an Experience to share on our own website, third party websites and social channels (including @letstikigai). Booking with us means you're comfortable being included in this unless you tell us in writing, before your Experience, that you'd rather not be. If you leave us a review or testimonial, we may also feature that, with credit if you'd like it.
 

13. Travellers Under 18

Anyone under 18 must be accompanied by a parent or legal guardian on an Experience, unless we've specifically agreed otherwise in advance (for instance, a school trip with its own chaperones). The accompanying adult accepts these Terms on the minor's behalf and stays responsible for their safety and behaviour throughout.
 

14. Insurance, Health & Emergencies

Our guides may carry a basic first-aid kit but are not medical professionals, and we don't guarantee medical care as part of an Experience. If something goes wrong, we'll do what we reasonably can to get you help, at your cost unless we've agreed otherwise.

We'd strongly encourage anyone joining a trek, forest safari, or waterfall Experience to arrange their own travel or personal accident insurance that covers outdoor activity, we don't include this in our pricing.
 

15. Your Information

We collect only what we need to process your booking and run your Experience safely,  your name, contact details, and any medical disclosures relevant to participation. We don't sell or rent this information, and only share it with the specific local partner delivering your Experience, or where the law requires it. 
 

16. Our Content

Everything we publish,  our website text, photos, itineraries, and the "Tikigai" name and logo,  belongs to us or our partners, and shouldn't be reused commercially without asking us first.
 

17. Governing Law & Disputes

These Terms are governed by the laws of India. If a disagreement comes up, we'd first look to resolve it through good-faith discussion or mediation. If that doesn't work within [30] days, it will go to arbitration under the Arbitration and Conciliation Act, 1996, seated in Margao / South Goa, conducted in English. Subject to that, the courts of South Goa, Goa will have exclusive jurisdiction.
 

18. A Few Last Things

  • If any part of these Terms turns out to be unenforceable, the rest stays in effect.

  • These Terms, together with anything we've confirmed in writing about your specific Experience, make up the whole agreement between us.

  • We may update these Terms from time to time; whatever version was in place when you booked is the one that applies to you.

  • You can't transfer your booking to someone else without checking with us first.
